Parsippany Mayoral Election Confirmed in Court as Judge Upholds Pulkit Desai’s Victory

Pulkit Desai, the Democratic candidate for Parsippany mayor, has officially had his victory reaffirmed in state Superior Court, more than a month after the initial election results were certified. Judge Noah Franzblau dismissed the third legal challenge filed by incumbent Republican Mayor James Barberio, cementing Desai’s win in a race decided by a narrow margin of 80 votes.

Desai initially secured the mayoralty in mid-November after all mail-in ballots were counted, a process that gave Democrats a critical edge in the town’s largest municipality. The court ruling on December 23 not only confirmed his win but also ordered Mayor Barberio’s campaign to cover Desai’s legal costs, although the total amount of those fees has yet to be determined.

The decision marks a significant moment in what has been a historic election cycle for Democrats in Morris County. The party’s momentum was evident throughout the year, with Congressman Mikie Sherrill securing a win in the county, Democrats capturing an Assembly seat in LD-25 for the first time in nearly five decades, and flipping multiple council seats. In his ruling, Judge Franzblau emphasized the high standard required for overturning an election. The burden of proof falls squarely on the petitioner—in this case, Barberio—to demonstrate that illegal votes were cast and to prove which candidate they affected. The court found that Barberio’s claims, which included allegations of illegal votes, improperly rejected ballots, mail-in ballot irregularities, and discrepancies in overvotes and undervotes, were largely unsubstantiated. The judge noted, “While petitioner’s assertions may be based upon ‘belief,’ it has been confirmed that petitioner’s assertions are not based on any information.”

Certain claims, however, were not dismissed outright. Lawyers for Barberio highlighted three ballots cast by voters who had passed away before Election Day, as well as a single mail-in ballot allegedly rejected in error. Even combined, these four ballots were deemed inconsequential in a race decided by 80 votes, leaving Desai’s lead intact.

Desai, who attended the Morris Democrats’ holiday celebration earlier this month, expressed confidence in the legal process and his ultimate victory. The court’s ruling validates that confidence and allows him to move forward with the responsibilities of office without further legal challenge.
